FASHION LAW: HARLEY-DAVIDSON AND MASS-RETAILER URBAN OUTFITTERS SETTLE LAWSUIT

Contemporary mass retailer Urban Outfitters is frequently accused of mimicking other labels’ designs, and Harley-Davidson is its newest rival. Urban Outfitters has been accused of reselling the motorcycle company’s branded merchandise under its Urban Renewal” label. In other words, Harley Davidson claimed items are sold without its permission, illustrating blatant violations of products branded with the Harley-Davidson marks.

Harley-Davidson filed a suit in Wisconsin District Court claiming direct violation of its trademarks as UO violated its trademarks by reselling their products under the “Urban Renewal” label without authorization. The products under fire are authentic Harley-Davidson apparel that have been reconditioned and altered – this includes the cutting and modifications to its original material – as well as the removal of the Harley-Davidson hangtags.

A representative for Harley-Davidson stated, “The unauthorized products are flagrant violations of Harley-Davidson’s standards for products branded with the Harley-Davidson marks.”

Urban Outfitters has agreed to settle Harley-Davidson Inc.’s trademark infringement suit as of this past June. The lawsuit the motorcycle brand originally filed in March is now amicably resolved. Best choice on Urban Outfitters end thus far, to avoid the expenses and time associated with it going to trial.
